Experience
- Advising on the obtention and renewal of regulatory authorizations for the provision of public telecommunications services before the Ministry of Transport and Communications (MTC).
- Defining legal strategies for the modification of technical characteristics of granted public telecommunications service concessions, including coverage plans, radio spectrum management, and numbering resource allocation, among others.
- Designing and implementing legal defense strategies in administrative sanctioning proceedings before OSIPTEL and the MTC for alleged administrative infringements.
- Negotiation and legal structuring of active and passive infrastructure sharing agreements, as well as management of regulatory authorizations for the operation and deployment of telecommunications infrastructure.
- Advising on administrative proceedings related to tariff setting and review, interconnection charges and access conditions before OSIPTEL.
- Leading regulatory legal due diligence in telecommunications asset acquisitions, assessing compliance risks, investment commitments and the validity of regulatory authorizations.
- Advising on the legal structuring and execution of investment projects and regional connectivity projects aimed at closing digital gaps, promoted by the MTC and/or ProInversión.
- Advising on the obtention of registrations and authorizations for the commercialization of public telecommunications services and the homologation of telecommunications equipment, among others.
- Advising on the identification and review of regulatory obligations applicable to the operation of geostationary satellites before the MTC and the Andean Community (CAN), ensuring compliance with regional regulations by satellite capacity providers.
- Advising on the legal and contractual structuring of domestic and international financing transactions, including the creation of security interests over critical assets such as towers, fiber‑optic networks and active equipment.
- Assessing feasibility and designing legal structures for the implementation of telecommunications services and emerging technology solutions under the Peruvian regulatory framework.
- Defining administrative and judicial defense strategies in proceedings related to the determination and audit of the Spectrum Usage Fee (Canon) and the Regulatory Contribution before the MTC and OSIPTEL, respectively.
Fabiana is Of Counsel in the Telecommunications, Media & Technology practice. She focuses her practice on telecommunications regulation, regulatory disputes and strategic advisory for regulated industries, advising operators, infrastructure companies and technology providers on complex regulatory and compliance matters in Peru.
Fabiana has significant experience assisting clients with regulatory strategy, infrastructure deployment and investment projects, as well as representing companies in administrative proceedings before sector regulators. Her work frequently involves engagement with authorities such as the Ministry of Transport and Communications (MTC) and OSIPTEL on matters related to spectrum regulation, interconnection, tariff frameworks and telecommunications infrastructure. She also advises on the regulatory aspects of telecommunications transactions and financings, including due diligence processes, risk assessment and the structuring of projects involving critical digital infrastructure.
Fabiana has extensive experience advising companies in the telecommunications, technology, healthcare and other regulated sectors, with a focus on regulatory compliance, administrative litigation and the structuring of complex commercial operations. Prior to joining the firm, she was an associate at Miranda & Amado from 2013 to 2025, where she focused on Telecommunications, Media & Technology, Personal Data Protection and Compliance.
Fabiana holds a law degree from the University of Piura and an MBA from EAE Business School (Barcelona). She has also completed studies in Digital Transformation and Innovation at UC Berkeley Extension and holds a specialization certificate in Compliance and Corporate Best Practices from the University of the Pacific.
She is a native Spanish speaker also fluent in English.
