Regarding control of mergers and concerted operations, until 2020, Peruvian regulation was limited to mergers and acquisitions in the electricity sector. Today, based on the new Law: “Ley de Control Previo de Operaciones de Concentración Empresarial”, antitrust control is applied to all sectors of the economy.

Our team, along with our experienced M&A department, has actively participated in a series of M&A authorization processes in the electricity sector, as well as in different processes in other jurisdictions as a result of cross-border transactions in which we have participated advising Peruvian business groups in their investments abroad. 

Furthermore, we advise our clients, in coordination with our Litigation and White Collar Crimes areas, in proceedings before the Peruvian antitrust authority, INDECOPI, referring to alleged collusive practices, price setting, unfair competition, among others. 

Additionally, we advise our clients on their commercial policies, advertising strategies, agreements with suppliers and clients, as well as policies with consumers, ensuring that their economic activities are in accordance with antitrust and consumer protection regulations. Therefore, we have a long experience evaluating, preparing and negotiating distribution agreements, supply agreements, joint ventures, among others that allow us to provide specialized antitrust consulting. 

Finally, along with our compliance team, we provide preventive advice to avoid interrogations by the authorities, as a result of operations and decision-making within companies.
