Experience
  • Representation of PerúPetro S.A. in an international arbitration administered by the Arbitration Center of the International Chamber of Commerce – ICC and initiated against PlusPetrol Norte S.A. and three South Korean companies, as well as their corporate guarantors. The dispute is related to the illegal termination of the License Agreement of Block 8, a situation that caused environmental, social and economic damages. Ongoing.
  • Advised one of the main mining companies in the country in negotiations with a private company in charge of supplying a reagent necessary for copper processing. The dispute was related to the damages suffered by the vessel hired by the private company to transport the reagent, which caused it to be stuck and unable to dock in the country. The result was favorable to the client, who obtained a new vessel with the cargo.
  • Representation of an important company specialized in the treatment and management of solid waste, in charge of the operation of the most important landfill plants in the country, in an arbitration initiated against the Peruvian State and related to the termination of the concession contract for the public cleaning service. The result was favorable to the client.
  • Representation of a Spanish medical company in an arbitration initiated against the Peruvian State in connection with the breach of a contract for the acquisition of hospital equipment entered between both parties. The result was favorable to the client.
  • Represented a state agency in an arbitration initiated against a private company in connection with the execution of a housing construction project in Piura. The result was favorable to the client.
  • Representation of one of the main shopping centers at national level in two arbitrations initiated against a private company and related to the payment of annual compensations discounted for surface rights. The first proceeding concluded with a favorable result for the client and the second one is ongoing.
  • Representation of a financial entity in several arbitrations initiated for the execution of trusts, each one related to a relevant agricultural project. The results were favorable for the client.
  • Institutional arbitration against a private party derived from a controversy related to the fulfillment of contractual obligations assumed to regulate the construction of a fish protein concentrate plant; the second of its kind in the world. The result was favorable to the client.
  • Representation of an important oxygen producing company in a dispute with EsSalud.
  • Representation of a consortium in an arbitration against a state entity related to the installation of video surveillance cameras in several cities of the country.

Carmela is a member of the dispute resolution team. Her practice is focused on advising clients in arbitration and judicial proceedings. She has experience in national and international arbitrations in commercial, corporate, construction, hydrocarbons, expropriations and public procurement matters. The latter have been processed under the rules of various organizations such as the International Centre for Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC), the Lima Chamber of Commerce (CCL), the American Chamber of Commerce of Peru (AMCHAM), among others.

She is a lawyer from Universidad de Lima, graduated with honors and ranked fourth place of the 2020-I class.

She has been teaching assistant of the arbitration course at Universidad Peruana de Ciencias Aplicadas (2022-2023) and Universidad Nacional Mayor de San Marcos – UNMSM (2021). In addition, she has been a teaching assistant of the conflict theory and dispute resolution mechanisms course at the Pontificia Universidad Católica del Perú – PUCP (2022).

In addition to her professional experience at the firm, Carmela was an associate of the dispute resolution team at Estudio Echecopar (Baker Mckenzie).

She is currently a member of the board of directors of the civil association Arbitraje Alumni. She was also a member of the board of directors of the civil association ADV Editores, which publishes the legal magazine ADVOCATUS.

Finally, she is an amateur runner and volunteer in Voz Animal Peru.
